After the wreck, police asked Smith to take a breathalyzer test, although at this time there is no available info on his blood-alcohol level, per Mike Garafolo of Fox Sports:

San Jose Police say Aldon Smith was arrested after being involved in a single-vehicle crash. No injuries reported.

- Mike Garafolo (@MikeGarafolo) September 20, 2013

Smith took a breathalyzer test that tested over the limit. Police have no information at this point on his blood-alcohol level.

- Mike Garafolo (@MikeGarafolo) September 20, 2013

Maiocco provides more detail from San Jose Police Sgt. Heather Randol:

"At some point, they did a breath sample and it was over the limit," Randol said.

"He was not injured, and it does not appear as if anybody else was in the vehicle with him. And there were no other involved vehicles or reported injuries."

Smith was booked into Santa Clara County jail, Randol said.

Further details are still emerging, but this is not the first time Smith has run afoul of the law for allegedly drinking and driving. Smith was arrested on suspicion of DUI in Miami after a 14-sack rookie season; authorities later reduced the charge to reckless driving.

Smith was also involved in an altercation in June of 2012 in which he was stabbed while attempting to break up a scuffle at a party. He's now being sued as a result of issues at the party. He was also a passenger in a car that flipped attempting to avoid an animal last September.

On the field Smith is one of the NFL's best defenders and is coming off a breakout campaign with 19.5 sacks last year. He's grabbed 3.5 in two games this season.

This latest run-in with the law comes two days before the 49ers welcome the Indianapolis Colts to Candlestick Park as San Francisco looks to move to 2-1 after a humbling defeat at the hands of the Seattle Seahawks on Sunday Night Football. Smith's status for the upcoming contest is now in jeopardy.
